A new law, which comes into effect in early April 2024, provides for a controlled release of cannabis and its active ingredient tetrahydrocannabinol (THC). However, one thing remains unchanged even with the legal use of the drug: driving under the influence of cannabis remains legally prohibited.

"People who cause an accident under the influence of cannabis act with gross negligence and thereby violate their duty of care," emphasizes Alexander Held. "This can lead to the comprehensive insurance reducing or even completely denying benefits."

Furthermore, the liability insurance can claim recourse if a driver causes an accident or damage due to gross negligence. This also applies if it happened under the influence of cannabis:

"This means that the insurance can reclaim up to 5,000 euros from the perpetrator," clarifies the insurance expert, adding: "Conversely, the good news is that accident victims are compensated by the motor liability insurance, even if the perpetrator was under the influence of drugs."

According to Alexander Held, it is best to avoid such a situation altogether:

"Ultimately, responsible behavior in traffic should always be a top priority - for the sake of one's own health as well as to protect other road users."
